These are the Terms of Use ("Terms") governing the use of the IHI Jobs platform (“the website,” “We”, “the platform”) by you, employers, job seekers, and other users. These Terms include the IHI Jobs Privacy Policy. The IHI Jobs platform is owned by Godian Global, LLC.

By signing up to use the IHI Jobs Platform, you represent to Godian Global, LLC, herein referred to as GODIAN GLOBAL (or the Company, or the Website, or IHI Jobs) that you have read, understand, and agree to be bound by the following terms and conditions of the Agreement governing your use of this Platform which may also be referred to as “the Service,” “the System” or ‘the Platform” If you do not agree with the terms and conditions of this Agreement, you should not sign up to use the IHI Jobs learning Platform.  This Agreement is between you and GODIAN GLOBAL and your agreement to be bound by the terms and conditions hereof is in consideration of GODIAN GLOBAL issuing you access to the Platform, which access is subject to and governed by this Agreement. You hereby agree with GODIAN GLOBAL as follows:

These Terms will be the binding agreement between You and IHI Jobs. Each time you use the website, you are agreeing to the terms. If you do not agree with the terms, you will refrain from using the website.

If you violate these terms, your usage and access to the site may be suspended or terminated by IHI Jobs.

You must be 13 years of age or older to use the website. If you are younger than 13 years, you should not use the website unless you are being monitored and supervised by an adult who is your parent, legal guardian, or a responsible adult.

Children’s Privacy. We do not intentionally collect personal information from children under 13. If we find out that a child under 13 has given us personal information, we will take steps to delete that information. If you believe that a child under the age of 13 has given us personal information, please contact us at our Help Center.

We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices. When you use the IHI Jobs Platform, you are agreeing to this Privacy Policy and any updates we make to it.

You may use our Service only for only the following purposes; searching for employment, searching for candidates, connecting with employers, candidates, or other users, and reading articles on the website. You will not manipulate or disrupt the Service. You will not transmit illegal, obscene, harmful, threatening, criminal, libelous information or data using the Service.  We strive to implement and update administrative, technical, and physical security measures to help protect your Personal Information against unauthorized access, destruction, or alteration. However, no method of transmission over the Internet, and no method of storing electronic information, can be 100% secure. So, we cannot guarantee the security of your transmissions to us and of your Personal Information that we store.

It is your responsibility to maintain the confidentiality of your account, including your password, user name, profile, and any other information.  

GODIAN GLOBAL hereby grants you a non-transferable, non-exclusive right to use the Service, solely for your own purposes, subject to the terms and conditions of this Agreement. GODIAN GLOBAL and its licensors reserve all rights of ownership and any rights not expressly issued to you in this usage agreement.
If you are a direct competitor of GODIAN GLOBAL, you should not access the website or use the software or system without prior written consent from GODIAN GLOBAL. You should not scrape data from the website, contact users on the Platform, monitor its performance, impair its performance, or functionality.  

You shall not try to decompile or manipulate the code used the website.

As a User or User of the Service, you shall not issue a license, or sublicense, sell, resell, assign, transfer, distribute or otherwise make available to third parties the System, Service, Content or Platform. You shall not alter, modify the website, or create clones or copies of the works on the Platform. You will not reverse engineer the Service to design a competitive or similar product or Service. You will not share your user license with anyone else or transfer the license.

Inactive/Unused Licenses

If your account is inactive (no user logins have occurred) for a period of more than twelve months, GODIAN GLOBAL may delete your account without notice. Once your data is deleted, it will be irrecoverable.  

Account Information & Data

GODIAN GLOBAL has no ownership or liability over the information, data, or material that you share or transmit using the Platform. You understand that as a user, you are fully and solely responsible for legal ownership, accuracy, reliability, quality, legality, integrity, and appropriateness of all Customer Data and Subscriber Data. GODIAN GLOBAL is not responsible or liable for the destruction, deletion, revision, correction, loss, or damage, or failure to protect Customer Data or Subscriber Data unless this includes Personal Data.

All users agree not to:

A)Violate the terms of use and privacy policy of the website
B)Use any data scraping, data mining, robots, or similar tool to gather or extract data from the website
C)Revere engineer or decompile any part of the website
D)Use any tool or device not authorized by IHI Jobs to search the website
E)Copy, aggregate, replicate, or duplicate any of the material on the website 
F)Use the name or logo of IHI Jobs without permission
G)Post spam or inappropriate material on the website
H)Post a resume that does not belong to the individual posting it
I)Share their login credentials with any individuals
J)Share false information to the website including resume, company data, or biographical data
K)Use the website for any illegal, unlawful, or immoral activity
L)Post any information that is libelous, disparaging, defamatory, obscene, threatening, racist, hateful, discriminatory, bullying, harassing or may cause pain, embarrassment, or anxiety to other individuals. IHI Jobs reserves the right to suspend or terminate the access of a user who posts such information. 
M)Impersonate any individuals, companies, or IHI Jobs 
N)Violate, attempt to violate, or hire other individuals to violate or attempt to violate the security of the website in any way
O)Post or promote information that endorses illegal or inappropriate activity
P)Use (without authorization) or manipulate the work of other users that is protected by copyright
Q)Send unsolicited emails, text messages or mail to other users, or contact other users via mail, social media, or fax.
R)You understand that any violations of the IHI Jobs website or network security may lead to civil and/or criminal liability.  

Employers

If you are an employer, you agree that you wholly and solely responsible for your postings on the website. IHI Jobs will not be held liable for any inaccuracies, or acts of commission or omission that result in civil or criminal liability, resulting from an employer’s job post. IHI Jobs and its parent company are not employers as it relates to your use of the website and cannot be held liable for your employment decisions.

You agree that your entire account information, including saved resumes, candidates, job posts, contacts, and mailing lists, will be deleted if you cancel your employer account or if the account is terminated for non-payment or breach of our terms and conditions, or for any other reason. We reserve the right to monitor your usage of the website to ensure that you are not sending out excessive emails or requests to other users, or pushing advertising,

We will keep your information confidential except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies or during an emergency circumstance. Generally, we will only use your information within our company. However, sometimes we use third parties to process your information (for example as credit card payment Providers). We will require these third parties to comply strictly with its instructions and we will require that they not use your personal information for their own business purposes.

The Uses of the Data Collected by IHI Jobs

• IHI Jobs uses non-identifying and aggregate information to better design our Web site and to use in research and trend analysis. For example, we may tell an advertiser that X number of individuals visited a certain area on our Web site, or that Y number of men and Z number of women filled out a site survey or form, but we would not disclose anything that could be used to identify those individuals. We only provide data to our partners, if any, after we have removed your name and any other personally identifying information from it, or have combined it with other people's data in a way that it no longer personally identifies you.
• The anonymous and aggregated data also may be published through various media Platforms/academic journals. No personal identifying information will be tied to the results, and IHI Jobs will not share anything that could be used to identify your account or your private information.
• From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change in the future, we will contact you before we use your data for these new purposes to notify you of the policy change and to provide you with the ability to opt out of these new uses.
• IHI Jobs stores data only for as long as it is necessary to provide products and Services to you and others, including those described above and for legal protections or as required by applicable laws and regulations.
• IHI Jobs may enable access to public information that has been shared through our Services.
• IHI Jobs may allow Service Providers to access information so they can help us provide Services.
• We may also disclose your information to our subsidiaries and affiliates;
• To contractors, Service Providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential.
• As required by law, which can include providing information as required by a court order.
• When we believe in good faith that disclosure is necessary to protect your safety or the safety of others, to protect our rights, to investigate fraud, or to respond to a government request.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of IHI Jobs' assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information maintained by the Site is among the assets transferred.
• For any other purpose disclosed by us when you provide the information.
• IP addresses may be used to identify the location of users, the number of visits from different countries and also to block disruptive use; and to analyze and improve the Services offered on our website, e.g. to provide you with the most user-friendly navigation experience.
• Certain information is needed to provide you with Services, so we only delete this information after you delete your account.
• Some forms of processing (sending promotional information, commercial profiling, behavioral advertising, geo-location, etc.) may require the express consent of the User. Specific information may be shown on the pages of the Site in connection with particular Services or processing of Data provided by the Site User.
• IHI Jobs uses industry-standard encryption technologies when transferring and receiving consumer data exchanged with our site. If you feel that this site is not following its stated information policy, you may contact us at Info@IHIJobs.com.
• For content that is covered by intellectual property rights, like photos and videos you specifically grant IHI Jobs a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with the IHI Jobs app or IHI Jobs (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
• Protecting the Privacy of your fellow IHI Jobs Users
• During your use of IHI Jobs Services, you will not send or otherwise post unauthorized commercial communications (such as spam) on IHI Jobs.
• You will not collect users' content or information, or otherwise access IHI Jobs, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission:

                      o  You will not run malicious software, code, or viruses on the app or site. 
                      o  You will not solicit login information or access an account belonging to someone else.
                      o  You will not abuse, bully, intimidate, or harass, or impersonate another User.
                      o  You will not post content that is threatening, racist, hateful, pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

• You will not provide any false personal information on IHI Jobs, or create an account for anyone other than yourself without permission. You will not create more than one personal profile. You will not attempt to another user's account unless they have given you permission. You will not change the name that you registered with after you have already been approved on the Platform.

Copyrights: IHI Jobs and Protecting Other People's Intellectual Property Rights

Here at IHI Jobs, we respect other people's rights, and expect users of the app to do the same. You will not post content or take any action on IHI Jobs that infringes or violates someone else's rights or otherwise violates the law. You will be held liable for any action or postings that are deemed harmful to other users. We can remove any content or information you post on IHI Jobs if we believe that it violates this Privacy Policy or the Terms of Use on this Site. You will not use our copyrights or any confusingly similar marks, without our written permission. If you collect information from IHI Jobs Users, you will: obtain their consent, make it clear you (and not IHI Jobs) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it. You will not post anyone's identification documents or sensitive financial information on IHI Jobs. You will not tag IHI Jobs fellow Users or send email invitations to non-users without their consent. You will not pretend to represent IHI Jobs or enter into business transactions on behalf of IHI Jobs. You will notify IHI Jobs immediately if your account has been compromised. You are fully responsible for any activity that takes place on your user account.  

Intellectual Property Ownership

You understand and agree that GODIAN GLOBAL (and its licensors, where applicable) own all rights and interest of the IHI Jobs Platform. You understand that you are not an owner, franchisee, or distributor, or agent of IHI Jobs. The IHI Jobs name and logo and associated product names are trademarks and Service marks of GODIAN GLOBAL. GODIAN GLOBAL has not issued you any right or license to use, exploit, or manipulate them.  

Third Party Service Providers & Vendors

As part of your use of the Platform, you may correspond with and purchase Services from third party enterprises or individuals. You understand that GODIAN GLOBAL does not guarantee the accuracy, integrity, appropriateness, legality, and authenticity, or currency of any data, information, or content provided by third parties on the Platform. You agree to promptly notify GODIAN GLOBAL of any suspected illegal, unlawful, tortious, or inaccurate use of the Platform. You agree that GODIAN GLOBAL has the right to delete, deactivate, or remove any content that the company believes to be unlawful, inaccurate, or tortious. GODIAN GLOBAL will not refund the fees paid for access to content that was deleted, suspended, or removed from the Service, or accounts that were deactivated for misuse or abuse or unlawful activity.  

Non-Payment, Account Deletion or Suspension

GODIAN GLOBAL reserves the right to suspend, or deactivate your access to the Platform in the even that you fail to make timely payment, or your method of payment fails or is charged back. In the event of a suspension or termination, you will be liable for any balance on your account. You agree that GODIAN GLOBAL is authorized to charge any outstanding fees to your credit card or the method of payment that you have on record.

Job ads
You agree not to post a job ad (or any ad) that:

1. Promotes illegal, unlawful, or unethical activities
2. Contains the names, trademarks, or logos of unaffiliated companies or uses the trademarks or service marks of another company without permission
3. Contains more than one job or job description
4. Posts misleading, false, or inaccurate information
5. Post jobs that require citizenship or permanent residence of any country as a condition of employment, unless required by law.
6. Contain hyperlinks
7. Uses more than a single location or uses more than a single job category
8. Contains keywords, such as cities, job titles, and company names that are not relevant to the posting
9. Contains exploitative, sexual, pornographic, or phishing material or solicits children
10. Post jobs for competitors
11. Post jobs that require upfront payment by the applicant
12. Post jobs that promote career fairs, conferences, hiring events, open houses, retreats, etc.
13. Promote or advertise a company’s services and products
14. Post jobs that are based on only commission payments, unless the posting expressly states so, and also states how much the candidate will receive in commissions.
15. Post pyramid schemes, multilevel marketing opportunities, franchise schemes, sales representative agency programs, distributorship, etc.
16. Promote sexual activities
17. Promote jobs for acting, talent, or modeling
18. Promote jobs related to adult entertainment or any type of sex work
19. Seek to use human body parts or require the donation of human parts of any kind.
20. Post jobs that promote religious or political positions
21. Post jobs that discriminate against candidates based on race, nationality, gender, economic status, or age. 
22. Post jobs that ask candidates to provide information about their ethnicity, religion, physical health, mental health, age, criminal background, trade union membership, and sexual life, unless permitted and or required by law.
23. Posts jobs for countries that are under economic sanctions by the US government
24. IHI Jobs has the right to delete any job ad or ad which breaches the Terms and Conditions and Privacy Policy of the IHI Jobs platform. IHI Jobs has the right to delete any job posting or ad for any reason. Your use of the IHI Jobs platform may be terminated at any time for misuse of the IHI Jobs platform.

Employers

As an employee or recruiter, you agree to use the IHI Jobs Resume Database in accordance with the Terms and Conditions and Privacy Policy of the IHI Jobs platform. You agree not to share any data from our resume database with any unauthorized users, if you are not using the platform for employment purposes.

You will take appropriate steps to secure and protect the data you obtained from the IHI Jobs platform.
You will not share your password or login information with any party that is not part of your organization.

You will not target any applicants whose names you obtained from IHI Jobs with advertising, services, products, or promotions

You will not contact other users on the IHI Jobs platform with excessive emails, fax messages, text messages, and phone messages
You will not contact applicants on the IHI Jobs platform with business offers, opportunities, or career fairs
IHI Jobs may limit the number of searches or messages that you can send to other users on the platform. You understand that we may change the rules relating to applicant contact at our discretion.

By using the IHI Jobs platform, you represent and warrant that you are not located in, under the control of, or a national or resident of any country that is under an economic embargo by the USA.

Applicants

You agree not to share your login information for the IHI Jobs platform with other individuals or entities
You may be asked to login with Google, Facebook, or email and to provide information for your profile
You agree that the information provided on your resume or CV is accurate and not false, misleading, or designed to deceive potential employers

You agree that you will be asked to provide information relating to your name, address, location, education, career, and professional experience for your profile.

We may offer you third party services and products and you agree to receive these offers.
You understand that you do not have any ownership of any part of the IHI Jobs platform, and that you will lose your account information if your access to the platform is deactivated, suspended, or cancelled. You understand that information such as resumes, job postings, saved jobs, and messages may be lost after you lose access to the platform. You understand that IHI Jobs has the right to delete your account and any information in your account if you have been inactive for an extended period. 
By using the IHI Jobs platform, you represent and warrant that you are not located in, under the control of, or a national or resident of any country that is under an economic embargo by the USA.
Candidate profiles must contain accurate information and must describe the candidate. Profiles should not depict a fictional character, a location, animal, or object.  

User submissions and content

All information including text, graphics, data, video, audio, photos, messages, advertisements, or any other material submitted or generated by you and posted on the IHI Jobs platform is the user’s sole responsibility. IHI Jobs does not own any of the information or control the information. It is your responsibility to protect your intellectual property, trademarks and service marks. When you post any user content on the IHI Jobs platform, you are granting IHI Jobs a non-exclusive, worldwide, royalty-free, transferable, sub-licensable license to reproduce, use, publish, adapt, share, and distribute your user content on IHI Jobs. You also grant IHI Jobs permission to use such user content to promote IHI Jobs. IHI Jobs reserves the right to refuse to publish, accept, or share any user content, at its discretion.

IHI Jobs does not guarantee that any user content posted on the IHI Jobs platform is accurate, reliable, current, or reliable.
You agree to grant IHI Jobs the right to use any content that you post to the IHI Jobs platform.
You agree that you have the right to post any jobs that you post on behalf of any employer or company

Notification on Copyright and Trademark Infringement. 

If you believe that your trademark, copyright or service mark has been infringed upon, contact IHI Jobs by email at Info@IHIJobs.com.

IHI’s Liability.

IHI does not routinely screen, research, or censor job postings, resumes, candidate profiles, company profiles, or ad postings. IHI Jobs is not responsible for user content, jobs or ads posted, and the accuracy, reliability of such postings. IHI Jobs has no liable for any content generated by applicants or companies. Users of the IHI Jobs platform agree that their use of the platform is at their own risk.

TO THE FULLEST EXTENT POSSIBLE BY LAW, IHI JOBS’ MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE IHI JOBS PLATFORM IRRESPECTIVE OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $100.

Service Disruption - Technical and Internet

You acknowledge that the Service may experience technical difficulties, internet delays or outages, glitches, general delays, and other issues. IHI Jobs is not liable for such issues, but will exercise diligence in resolving whatever issues can be remedied within its ability.

The IHI Jobs platform may contain errors, typographical errors. IHI Jobs makes no makes no representations about the accuracy, completeness, reliability, completeness, of any content on the IHI Jobs platform. We may make changes occasionally to the IHI Jobs platform at any time. IHI Jobs does not guarantee any results from a candidate’s resume posting or job search, or from an employer’s job posting, or ads.  

Some states in the United States forbid the exclusion of implied warranties or limitation of liability for consequential, incidental, or specific occurrences of damages. Some of the exclusions outlined in the foregoing may not be applicable to you. The proscription of such exclusions or limitations in your jurisdiction does not constitute an allowance of other warranties, liabilities, or limitations in other jurisdictions.

If You are a California resident, you hereby waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."

Disclaimer of Warranty.

TO THE FULLEST EXTENT POSSIBLE BY LAW, IHI JOBS DOES NOT WARRANT THAT THE IHI JOBS PLATFORM WILL OPERATE ERROR-FREE OR THAT THE PLATFORM WILL NOT BE AFFECTED BY VIRUSES, MALWARE, OR OTHER HARMFUL ATTACKS OR SITUATIONS. YOUR USE OF THE IHI JOB PLATFORM IS DONE AT YOUR OWN RISK AND YOU ACCEPT FULL RESPONSIBILITY FOR YOUR USE OF THE WEBSITE. IHI JOBS PLATFORM IS PROVIDED ON AN “AS IS” BASIS WITH NO WARRANTIES OF ANY KIND.

IHI JOBS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT TO THE FULLEST EXTENT ALLOWED BY LAW. IHI JOBS MAKES NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, MERCHANTABILITY, COMPLETENESS, RELEVANCE, OR TIMELINESS OF THE IHI JOBS CONTENT, POSTINGS, SERVICES, TEXT, GRAPHICS, IMAGES, SOFTWARE, THIRD PARTY LINKS, AND LINKS.

Disclaimer of Consequential Damages.

TO THE FULLEST EXTENT POSSIBLE BY LAW, IN NO EVENT SHALL IHI JOBS, ITS OWNERS, AFFILIATES, SUPPLIERS, PARTNERS, OR ANY THIRD PARTIES FEATURED ON THE IHI JOBS WEBSITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, DAMAGED DATA, LOST EMPLOYMENT OPPORTUNITIES, OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE IHI JOBS PLATFORM WHETHER ON THE BASIS OF CONTRACT, WARRANTY, TORT, OR ANY OTHER CIRCUMSTANCE, AND WHETHER OR NOT IHI IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These links are provided solely as a convenience to you and do not constitute an endorsement by IHI Jobs of the contents of such third-party Web sites. IHI Jobs is not responsible for the content of such third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party Web sites. When you access third party sites, you do so at your own risk.

No Resale or Unauthorized Commercial Use.
You agree not to resell, transfer, or assign Your rights or obligations under these Terms. You also agree not to make any unauthorized commercial use of the IHI Jobs platform.

Indemnity.

You agree to defend, indemnify, and hold IHI Jobs, its owners, affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the IHI Jobs platform.  

These Terms are governed by the laws of the State of Texas without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts in Dallas, Texas.

Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

In addition, failure by IHI Jobs to enforce any part of these Terms shall not be deemed as a waiver of such term or otherwise affect IHI Jobs’ ability to enforce such term at any point in the future. These Terms constitute the entire agreement between You and IHI Jobs with respect to the use of the IHI Jobs platform. No changes to these Terms shall be made except by a revised posting on this page.

Mobile Services.

If you access the IHI Jobs platform on a mobile device, you understand and agree that information about your use of the platform through Your mobile device and carrier may be communicated to IHI Jobs, including but not limited to your physical location, your mobile telephone carrier, and your mobile device. You agree to accept any charges from your mobile carrier that may be related to your use of the IHI Jobs platform on your mobile device.

You are responsible for all charges and permissions when you access the IHI Jobs platform from your mobile access provider.  When you use a downloadable application to access IHI Jobs, you are consenting to the Terms of Service of the platform.
